Agreement to Terms

By accessing or using ChessOTB.ca and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Service.

Description of Service

ChessOTB is a software platform for over-the-board chess players, families, coaches, clubs, and organizers. Depending on the feature, the Service may include:

• Player, club, coach, and tournament discovery tools
• Player profiles, public profile pages, and profile-claim workflows
• Tournament Copilot and related preparation, tracking, and analysis features
• Paid subscriptions, credits, and other premium access features
• Community submissions, uploads, notes, and other chess-related resources

Some features rely on third-party data sources, third-party service providers, or experimental analysis tools. Availability may change over time.

Eligibility and Minors

You may use the Service only if you can form a binding agreement under applicable law. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms on your behalf and is responsible for your use of the Service.

If you create or manage an account, profile, or purchase for a minor, you represent that you are authorized to do so and that the information you provide is accurate.

Accounts and Access

When you create an account or use account-based features, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We may suspend or restrict access if we reasonably believe an account is being used unlawfully, abusively, or in a way that risks the Service or other users.

Public Chess Data and Profile Claims

The Service may display player, rating, club, title, tournament, or other chess-related information sourced from public or licensed sources such as chess federations, organizers, or publicly available event records. That information may be incomplete, delayed, or inaccurate.

If you claim a player profile or connect a public profile to your account, you represent that you are authorized to do so. We may review, approve, reject, or revoke claims at our discretion.

User Content and Uploads

If you submit notes, files, images, avatars, game records, community intel, or other content through the Service, you represent that:

• You have the right to submit the content
• The content does not violate any law or third-party rights
• The content is not malicious, deceptive, abusive, or harmful
• You have any permission needed for content involving minors or other people

You retain ownership of your content, but you grant us a non-exclusive license to host, store, process, reproduce, adapt, and display it as needed to operate, secure, improve, and promote the Service.

Paid Plans, Billing, and Credits

Some features require payment, including subscriptions, premium access, credits, or other add-ons. Prices, billing intervals, included usage, and feature access may change over time. If you purchase a recurring subscription, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel.

Unless otherwise stated at checkout, subscriptions renew automatically until canceled. You can manage or cancel eligible subscriptions through the billing tools we make available. Except where required by law, fees already paid are non-refundable, and unused credits or promotional benefits have no cash value.

Tournament Copilot and Informational Outputs

Tournament Copilot, analysis tools, projections, suggestions, OCR, extracted notes, and similar outputs are provided for informational purposes only. They may contain errors, omissions, or outdated information and should not be treated as guaranteed results, official pairings, official standings, or professional advice of any kind.

You remain responsible for how you interpret and use Service outputs.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit false or misleading information
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to our systems
• Copy, scrape, resell, or commercially exploit the Service without permission
• Upload malware, spam, or harmful content
• Harass, abuse, impersonate, or endanger other users
• Misuse public profile, claim, or visibility tools

Intellectual Property

The Service, including our site design, branding, software, and original content, is owned by ChessOTB or our licensors and is protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Service.

Termination

We may suspend or terminate access to the Service at any time if we reasonably believe these Terms have been violated, the Service is being misused, or the Service must be changed or discontinued. You may stop using the Service at any time.

Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, ChessOTB will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of CA$100 or the amount you paid us in the 12 months before the event giving rise to the claim.

Governing Law

These Terms shall be governed by the laws of British Columbia, Canada. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of British Columbia.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after the updated Terms become effective means you accept them.
